Liability Waiver

I am voluntarily participating in physical exercise that can be strenuous and subject to risk of serious injury during PRIVATE OR GROUP TRAINING. I agree to the follow below:

Comprehensive Release:
I release and discharge the fitness studio Groove by B GmbH, its owners, employees, instructors, agents, and affiliates from any and all liability, claims, demands, or causes of action arising from participation.
Scope of Release:
The release covers all activities, classes, use of facilities, equipment, and any on-site or off-site events organized by the studio.
Participant's Agreement to Indemnify:
I agree to indemnify and hold harmless the studio and its representatives from any claims, liabilities, damages, or expenses (including legal fees) arising from their actions, negligence, or failure to adhere to studio policies.
Health Declaration:
I confirm I am in good health and have no medical conditions that would prevent safe participation.

Groove by B GmbH urges you to obtain a physical examination from a doctor before beginning any exercise or training program. You agree that by participating in these physical exercise sessions or personal training activities, is at your own risk. I recognize that exercise is not without some risk to the musculoskeletal system (e.g. sprain, strain) and cardiorespiratory system (e.g. dizziness, fainting, abnormal heartbeat, discomfort in breathing, abnormal blood pressure response, and in rare instances, heart attack or stroke). I acknowledge that not all risks can be known in advance.

I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, “Releasor,” “I” or “me”, which terms shall also include Releasor’s parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity.

I HEREBY release and forever discharge Groove by B GmbH, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively “Releasees”), from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Activity.

I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney fees and any related costs.

I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I should require medical care or treatment, I authorize Groove by B GmbH to provide all emergency medical care deemed necessary.

I FURTHER ACKNOWLEDGE to the cancellation policy below:

Strict Cancellation Policy:
I acknowledge and agree to adhere to the studio's cancellation policy, which requires cancellations to be made within a specified time window prior to the class.
No Monetary Refunds:
The studio does not offer monetary refunds for cancellations made outside the allowed window or for any unused class credits.
Credit-Only Refunds:
Refunds, if applicable, will be issued as class credits only, not as cash or credit card reimbursements.

I FURTHER ACKNOWLEDGE that during classes, events, or sessions conducted at Groove or any external locations any Groove employee may create audio, visual, or audiovisual content (including photographs, videos, or recordings) related to the classes or events.
2. By participating in or attending classes or events at Groove, I consent to my own likeness and voice potentially being captured in the content created by Groove or its representatives.
3. To Groove using, reproducing, distributing, modifying, displaying, and publishing the content, in whole or in part, for promotional purposes, in any media format, including but not limited to any platforms.
4. I will not have any right to review or approve the content before its use, and I will not be entitled to any compensation for the use of such content.
5. That Groove shall have the right to assign, license, or transfer the rights granted herein to any third party, without my prior consent, provided that such third party is also bound by the terms of this agreement.
6. That while Groove will make reasonable efforts to respect my privacy, there is no guarantee that other participants or attendees will not capture my likeness or voice. Groove shall not be held responsible for any content created by other participants or attendees.
7. If I do not wish to be photographed, filmed, or recorded during classes or events, I must inform Groove in advance, and Groove will make reasonable efforts to accommodate my request.

I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. In the event that any damage to equipment, field or facilities occurs as a result of my or my family’s or my agent’s willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness. Both participant and Groove by B GmbH agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted altering or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
